Delhi’s CM Rekha Gupta has ordered immediate sealing of buildings with unauthorised fifth floors citywide, suspended five MCD officials, and confirmed the PG owner's arrest.
A day after the Satya Niketan collapse killed seven people, Delhi Chief Minister Rekha Gupta announced a citywide enforcement drive targeting a specific structural violation, buildings with an unauthorised fifth floor added beyond what their sanctioned plan allows. "Immediate sealing of buildings with unauthorised fifth floors has been ordered across Delhi," Gupta said, adding that PGs and buildings near the collapse site were being inspected too, with sealing among the penalties for violations found.

The enforcement response reached inside the MCD itself. Five officials from the corporation's South Zone were suspended with immediate effect: Deputy Commissioner Rakesh Kumar, Superintending Engineer Ranvir Singh, Executive Engineer Lalit Kumar Goel, Assistant Engineer Sunil Chauhan, and Junior Engineer Ashish Kumar. The suspension orders came from the MCD Vigilance Department under the DMC Services (Control and Appeal) Regulations, 1959, and each official remains entitled to a subsistence allowance while the disciplinary proceedings run their course.
Delhi Police apprehended the building's owner in Bhiwadi, Rajasthan, following a Look Out Circular and a search operation involving ten teams. Reports on the owner's name diverge slightly, some identify him as Hariram Gupta, others as Hariram Bansal, so we're flagging that discrepancy rather than picking one silently. His wife and son were also produced in court, with the owner and his wife sent to 14 days of judicial custody and the son remanded for two days in police custody. The three face charges including culpable homicide, negligence in the upkeep of a structure, and endangering public safety.
The term matters because it's specific, not a general catch-all for old buildings. Delhi's building bylaws typically cap plotted residential construction at a defined number of floors depending on plot size and road width, and a fifth floor added beyond that sanctioned limit is a documented category of violation the MCD already tracks, rather than a new classification invented for this crackdown. Investigators have said the collapsed building itself had additional floors built without permission, alongside basement repair work and no confirmed second exit, which is part of why this particular violation is the one being targeted first.
It's worth being precise about what this order actually is. It's a targeted sealing drive against one specific, identifiable violation across existing buildings, distinct from the separate structural-audit and safety-certification policy the Delhi government is drafting for PGs, hostels and similar public-use buildings. The sealing order can move immediately against buildings already known to have unauthorised floors, while the audit policy is a longer-term framework still being finalised.
If your building, or one you're evaluating as a buyer, has more floors than its original sanctioned plan shows, on paper or in practice, that gap is now the kind of thing MCD teams are actively looking for, not something likely to stay unnoticed. Checking your building's sanctioned floor count against what's actually built, and confirming any addition went through proper approval, is a reasonable thing to do this week rather than after a notice arrives.
